The appeals process in bankruptcy provides that a party may seek review of a decision or ruling of the Bankruptcy Court by a higher Court. Zalkin Revell has had substantial experience in bankruptcy appeals and has the experience necessary to defend our clients through the appeals process. Unlike a typical appeal, the appeal from a Bankruptcy Court has one additional level of review in that the decision is first appealed to the U.S. District Court. After a ruling from the U.S. District Court, the case may then be appealed to the Eleventh Circuit Court of Appeals and, following that, a party may seek a writ of certiorari from the United States Supreme Court.
Zalkin Revell attorneys are skilled at legal research and writing, and familiar with the unique bankruptcy appeals process. There are technically complex, bankruptcy specific, doctrines, such as equitable mootness, which may play a part in any bankruptcy appeal. Accordingly, it is important that an attorney handling bankruptcy appeals be familiar with the bankruptcy-specific law related to such appeals.
Zalkin Revell handles appeals for its clients and is also available to handle bankruptcy appeal referrals from other lawyers. An experienced appellate attorney with Zalkin Revell will be pleased to confer with you regarding the viability of a potential bankruptcy appeal or the defense of the same.
